Two face trial over allegations of theft, assault

Men of the Osun State Police Command have arrested two men over allegations of stealing, assault and damaging of a vehicle.

After investigation, the police dragged the two suspects, namely Adebayo Joshua and Maikudi Garba, before a Magistrate’s Court sitting in Osogbo, the Osun State capital.

The Police prosecutor, Inspector Kayode Adeoye, informed the court that Joshua, aged 21, and others now at large, on January 8, at about 5pm at Kobongbogboe area, Osogbo, conspired to commit acts amounting to theft and assault.

Adeoye said that Joshua swooped on a resident of Osogbo, identified as Taiwo Afolabi, and robbed him of the sum of N4, 000 after beating him up.

The defendant was said to have inflicted injury on his victim’s right eye with a punch.

Joshua, who was said to have been armed with a gun and a cutlass, allegedly threatened to kill Taiwo.

The charge pressed against him read that “Adebayo Joshua, on 8th of January, 2023 at about 5pm, at Kobongbogboe area, Osogbo, did steal cash sum of N4,000 only, property of one Afolabi Taiwo and thereby committed an offence contrary to Section 383(1) and punishable under Section 390(9) of the Criminal Code, Cap 34, Volume II, Laws of Osun State, 2002.

“You did threaten to kill one Afolabi Taiwo with a gun and cutlass and thereby committed an offence contrary to and punishable under Section 86 of the Criminal Code, Cap 34, Volume II Laws of Osun State, 2002.

“You did beat up one Afolabi Taiwo with your fist blow and stick and inflict injury on his right eye and thereby committed an offence contrary to and punishable under Section 355 of the Criminal Code, Cap 34, Volume II Laws of Osun State, 2002.”

Chief Magistrate Olusola Aluko granted the defendant bail in the sum of N50, 000 with one surety in the same amount after Joshua pleaded not guilty to the allegations.

In the same vein, Maikudi Garba, aged 45, was arraigned on one count of damaging a resident’s vehicle valued at N1, 900,000.

Garba allegedly committed the offence sometimes in October, 2022 at Sabo area, Osogbo.

The charge brought against him read that “You, Maikudi Garba, aged 45, sometimes in the month of October, 2022 at Sabo area, Osogbo in the Osogbo Magisterial District, did maliciously damage one KIA Optima motor valued at N1,900,000 (One million nine hundred thousand naira) only, property of one Afolabi Fasanmi, and thereby committed an offence contrary to and punishable under Section 451 of the Criminal Code, Cap 34, Volume II Laws of Osun State, 2002.”

Chief Magistrate Olusola Aluko granted him bail in the sum of N1 million with one surety who must be resident in Osogbo.
The matter was adjourned till March 6 for mention.
