Varsity don, lawyer, secretary, septuagenarian wife arraigned for forging late professor’s will

Five accused persons, including a lawyer, a professor, a doctor, a secretary and deceased wife of a late university don, yesterday appeared ‎before the Magistrate’s Court sitting in Iyaganku, Ibadan, Oyo State, for forging and altering the will of a deceased professor. 

The five suspects include 72-year-old lawyer, Mr. Fasomo Falola; 41years old, Mrs. Akangbe Olubunmi, 41, who is the secretary of the deceased professor and 71-year-old Olubunmi Amusa, wife of the late university don.

Others are Prof. Adedoyin Soyibo, 70 and Dr. Junaid Olaniyi Ogundiran, 70.

The suspects were arraigned on a three-count charge with suit no. MI/318/2017

The prosecutor, Oriola James, told the court that the suspects, with others at large, on March 19, 2015, at about 9am at the Ibadan magisterial district did conspire to commit felony to wit forgery.

Oriola said that the suspects forged the signature on the will of the late Professor Oluwole Amusa on the said date and time.

The Prosecutor explained that on January 5, 2017 at the Oyo State High Court, Ibadan, the five defendants did knowingly and fraudulent altered the will of the deceased Professor Amusa

Professor Amusa,‎ who was born on 18 June, 1946, died on August 11, 2016. Before his death, he served as the acting head, Department of Physical and Health Education, University of Ibadan, before his voluntary retirement from service in 1995.

The prosecutor said that the offences contravened sections 516, 467 and 468 of the Criminal Code Cap 38, Vol. II, Laws of Oyo State of Nigeria 2000.

In their augments, the counsels to all the defendants, Mr. Babatunde Ajijola for‎ the first and second defendants; Mr. Abdulwasiu Raheem for the third defendant; Mr. Omoyeni Odushola for the fourth defendant and Mr. Bolaji Agoro for fifth defendant, prayed the court to grant their clients unconditional bail after they had pleaded not guilty to the charges.

Counsels to the first and second defendants, Ajijola, prayed the court to give his client unconditional bail because he’s member of the bar as well as the deceased’s lawyer.
He added that the second defendant is the deceased secretary. 
In his own submission, counsel to the third defendant told the court that she’s the legal wife of the deceased and considering her age, she prayed the court to give her an unconditional bail

Also the counsel to the fourth defendant explained to the court that his client was a  long-time friend of the deceased and prayed the court to give him an unconditional bail 

Counsel to the fifth defandant in his argument also told the court that his client was an elderly man, who was not too healthy and needed to take good care of himself. He prayed the court to give him unconditional bail before the next adjournment. 

In his ruling, Chief magistrate Taiwo Oladiran adjourned the case till May 9, 2017, granting the suspects bail in the sum of N50,000 with one surety each for the second, third, fourth and fifth defendants.  
He, however, granted the first defendant, being a lawyer, bail on self-recognition with one surety and the submission of two photographs and his identity card.
